Understanding Mediation

Mediation can be a good solution for divorcing spouses who are able to work together to resolve their differences. In mediation, an impartial third party, the mediator, talks through all of the disputes with the sole purpose of helping the spouses negotiate a divorce agreement. The mediator does not represent either spouse, but each spouse has the right to have legal representation throughout the process. How Arbitration Works

In arbitration, the spouses agree on which arbitrator to hire and to allow him or her to decide those issues that they are not able to resolve themselves. Evidence is usually presented by each side in arbitration. Depending on the nature of your arbitration agreement, the arbitrator’s decision can be binding or nonbinding.
