Spousal Support (Alimony): Make Sure You Are Being Treated Fairly

Alimony is frequently a major concern in divorce proceedings. This can be especially true when one spouse was the primary breadwinner. Sometimes referred to as spousal support, alimony is not automatic in New Jersey. The court has a great deal of discretion in these matters, and a compelling case frequently needs to be made for alimony to be awarded.

Seeking An Alimony Order That Accommodates Your Needs

The court can order many types of alimony in these cases:

  • Temporary alimony: Also referred to as pendente lite alimony, temporary alimony can be awarded to provide financial support while the divorce is in progress.
  • Limited duration alimony: The court may decide to order alimony payments for a limited time based on the length of the marriage and the economic situation of the parties. Support will not last longer than the duration of the marriage.
  • Open duration alimony: This type of alimony is ordered after a long term marriage of 20 years or more. In considering the amount of the alimony award, neither party shall have a greater entitlement to maintain the prior standard of living.
  • Rehabilitative alimony: This type of alimony is typically intended to help the recipient spouse gain the education or skills necessary to obtain gainful employment.
  • Reimbursement alimony: The court can order reimbursement alimony in cases where the recipient spouse made significant contributions to the paying spouse’s education or career advancement.
